Recall that Mrs Nneameka Nwachukwu alledgedly pour hot oil on young Miss Margaret Joshua, who was left under her care as a result which she died from the burn.
In her ruling Justice Bassi said that the application submitted to this honorable court by the defence council Barrister Nwaiwu Richard seeking for bail with the counter application of the prosecuting council Barrister Mulleng Alexander, the court find no reasons from the point of law to grant the accused person bail in the case.
“The court finds no reasonable reasons in the defence application to grant bail to the defendant, being pregnant and falling sick from time to time is not enough from the point of law to grant bail in the case of culpable homicide.” Justice Bassi said.
Hon. Justice Bassi further said that there are no medical reports from a certified medical doctor from a government hospital to support the defendant application.
More so, the learned Judge said ” there is no reports from the correctional facility where the accused is held to back the application for bail “.
The court having sited many provisions of the law refuses to grant bail to Mrs Nwachukwu and the case was fixed for 27th March 2023.
